New Montage Responsibilities
New Montage will provide services as follows:
- Consultation. New Montage will consult with you to evaluate your needs and desires in order to create a finished project that will at least meet your expectations. This is a vital step in the process, as we gain a sense of you and your interests in order to create a visual and audio presentation that reflects your personality. We respect your privacy; all information you provide is treated with the utmost confidence and discretion.
- Construction. New Montage will begin work on your project after we receive all materials from you. Of course, should you discover an important piece of memorabilia (i.e., photo, video, scannable keepsake) after we have initiated the project, we will make every effort to include this in your montage and/or web site. Please understand that materials received after we begin work involve re-editing, retiming of audio and video, and re-rendering of items, which may result in delays.
- Media. Commercially published music is allowed within your work provided that the project is presented exclusively for personal use. Legal responsibility for any deviation from this resides solely with you. New Montage has no legally binding influence on how you present your project.
- Domain and Hosting. If you choose a package from New Montage that includes a web site, the first year of your domain and hosting is included in the package price. Ten months after your site is activated, New Montage will notify you of renewal options. New Montage currently purchases client domain names and hosts client web content through GoDaddy.com, which we find reliable and consistent. New Montage has no control or influence over GoDaddy’s servers; in the (unlikely) event of a hacked web site or server downtime, New Montage will make every effort to correct the issue promptly via consult with GoDaddy’s customer service department.
All projects require a 50% deposit, deliverable with your signed contract, before New Montage begins work. The balance is due within seven days of delivery of your finished project. Any balance 30 days past due will result in the project being removed from the server. New Montage accepts personal checks, money orders, e-checks, and credit cards via Paypal. Payment information will be provided when you initiate your order. You must be 18 years or older to sign a contract with us.
Memorabilia Delivery
New Montage is not liable for any loss, damage, or theft of materials you send us through the U.S. Postal Service or courier systems. If you send materials this way, please make copies and have them insured with delivery.
Content Manipulation
New Montage scans and processes hard copies of photos, audio files, and other memorabilia into digital formats for presentation on DVD and the Internet. We cannot ensure complete removal of audio noise or dust, creases, and/or scratches, especially on very old photos.
New Montage maintains proprietary control over the web pages for our clients. We will be pleased to work with you on customizing your site. If you have a blog, we will be able to embed that page within the design of your new web site.
Copyright
All materials supplied by the client for project development must either be the client's property or guaranteed by the client that copyright permission for use has been secured. New Montage is not liable for copyright infringements related to these materials.
Promotion
New Montage reserves the right to showcase a sampling of any products developed by us in our portfolio for promotional purposes. All video projects produced by us will include a brief (i.e., seven-second) studio spot at the beginning or end of the video. All web sites designed by New Montage carry a home-page bottom credit that links to our web site.
Limitation of Liability
New Montage reserves the right not to engage in any project or include material it deems offensive. New Montage reserves the right to delay or stop any project development for any reason without liability. New Montage will notify the client of any changes in status; should stoppage of a project initiated by New Montage result in termination of the contract, you will be refunded the deposit.
